My wife and I got into a fender bender (this case hood bender) last Sun with a Semi in which the semi rolled back into our Accord. :thumbsdow
The Driver stated that he did not believe that he rolled back into me so we called the cops. We were in stopped traffic due to another major accident, so the cops were not very far from us. I figured that I had a battle because I now have to "Prove" that I did not rear end him. Needless to say very sucky. The situation was not helped by the fact the "3" witnesses (in which none stayed) told the cop that I hit the semi.:thumbsdow So the cop gave us the standard Texas Blue forms, made us exchange information and get on our way. To keep this short, I called the semi's ins. carrier and reported the claim knowing that I had a battle on my hands. After some very cautious calls with the adjuster, she called me yesterday and told me that they would pay. :banana: I know I got lucky on this one.... Maybe this is an early christmas gift from santa. :thumbsup: I am glad too because the cost to repair the damage is $1776.

Ouch...not too bad of a damage. Just change the hood and the grill and paint it!

It's also good that you have them sign in papers that they're admitting fault, if there's 1 thing I learn in this world is, verbal doesn't count! Everything has to be in black & white.

They may say they'll cover you this time, but "after some other considerations" they may not.

Call them again, see if they can write you a letter admitting their fault and have them signed, if they ask why, just tell them your insurance company requires it to keep in file.

This way if they decide to "change their minds" they got nothing on you.

Again this is just a pre-caution, because as you said it's pretty hard for you to prove, especially with the 3 witnesses told the cop you hit him.

Dang you were so close to new headlights! :p

Now would be a good time to have them replaced if you want new, clear ones. ;).

If the cop had three names you could ask for them. If he does not give them up then it should be on your copy of the accident report. Unfortunately in Ohio, the accident reports are public record showing addresses and phone numbers. Anyone (including ambulance chasers) can see them and normally do.

I make it a point to get my own witnesses at the scene if possible.
After my witnesses said I was in the right of way, the other driver still would not admit guilt. The officer did site her.

Yes I need new headlamps.... :) I have the parts to do the TSX projector HID upgrade so on that front I will replace them, but on my own. I have a FSM so the removal of the bumper cover is not complicated.... I will just need more clips because I may get impatient.

I asked for the approval in writing... They are mailing it to me. I should get it on monday. I will wait until I have the letter before I send the car in for repair. As for the witnesses, the cop did not take a formal report because he did not want to do the paperwork. So there are no witnesses as far as anyone is concerned.

I know I am really lucky that the trucks insurance company is paying. Thanks for all of the suggestions and comments guys...

As an ex-insurance adjuster, you have nothing to worry about because the driver was honest and said he rolled back into you, which is why they accepted liability and paying for your damages.

I have to say that you are extremely lucky if they are excepting responsibility. It could of very easily gone the other way here. You are responsible for leaving a save distance between the one in front of you even when stopped and it is for this very reason why. I know he rolled back in to you, but you could of been cited for following too closely and not leaving enough space for him.

Accordtx1 said in his original post that the other driver's insurance carrier is paying his claim. If the other driver said he was rearended, they would have denied his claim. However, since they are paying his claim, the other driver must have admitted that he rolled back into Accordtx1.

Not exactly true. Many companies will go ahead and settle to avoid possible law suits and court cost.

Can always go with the JDM Inspire front end, replace with original parts, or have it repaired.

The way it looks it doesn't look that bad.

Update. :)

Got the car back today.:banana: Fixed exactly per estimate of $1776. I will post pictures later.

My wife has her baby (My former baby) at work.

Thanks to all who gave comments or suggestions. :thmsup:

This is true in our situation. The adjuster told me that the driver did not admit fault (I.e., admitting rolling into us), but since he admitted to doing paperwork in heavy traffic while driving the trucking company paid.

It also helps that I did not get angry. I did not get loud and unruly, and I never pushed the adjuster for answers in an unrealistic time frame. Again, I think this helped our situation.

I realize that we were lucky in this case. I have learned my lesson, and their driver learned his.... Since they paid he will be charged an accident on his company record..... never good if you drive for a living.

Yes... We were stopped and not moving
