rsnow24 05-20-2009, 09:53 AM I was hit yesterday by a Rav 4 heading in the opposite direction who decided to turn into a parking lot on my side of the street. She said she "didn't see" me and just made the turn right into the side of my car. I was driving so its scraped all the wall from the front to the rear bumper on my car even though the major impact was by my the drivers side front wheel. Ended up going to the hospital just to get checked out, ended up ok, just a little sore...odd thing is I was on the way to the hospital to study...

I'm just glad she had insurance, cause its not required here in NH...
I feel like the damage is worse than the pics show, but that may just all be in my head, so I'll take other ones soon. The front wheel is all messed up too.

after i hit a deer, my shop tried to put aftermarket crap in there, i made sure honda parts went back in, this was inside the engine ofcourse.. looks like you will need a front fender, door, rear panel and maybe the splash guard and that fender lining.. whatever its called..

Usually you only need a police report if there is injury or more than a dollar amount of damage(I don't know how you can verify that before an assessment). maybe its state by state

I was the moron in the RAV4 in your story except I got nailed and HARD in my 04 EP. Ended up totaled. But guess what...I was 6K upside down on it from a previous trade in but had GAP insurance so I was free and clear and ended up in an 05 RSX-S. Nice little upgrade for the same monthly payment. I was ok and I truly didn't see the other car either. That was the day I stopped sitting with my "gangsta lean" to the left making cars invisible behind the A pillar.

Not true, you should get a police report in any accident. If you don't, the other party may very well change her story and try to claim it on your insurance. This happened to me once and I learned my lesson the hard way.
A car drove past me while I was in a parking spot. Once I saw him pass I started backing up. The car that passed then for some unknown reason started backing up and backed into my car (Dodge Dynasty, no tears need to be shed). He was all apologetic as we switched insurance info (another no-no, I shouldn't give him mine when I'm not at fault and no police came). When I called his insurance he claimed I backed up into him. Since both cars had damage on the rear I don't have much ground to stand on. Both sides ended up paying own repairs. I had thought the 4 passengers I had in my car would be good enough as witnesses, but was told their testimony wouldn't count and I'd need outside witness.
Ever since this incident the first thing I do is call police and I don't say a word until they arrive.

Heh, I had a picture of Kaitlin from another thread there, very nice eye candy but in a matter of hours of having it up I received a private message and 3 add-friend requests. So needless to say I took it down immediately.

The police were not present during the accident, they CAN NOT attest to what happened.
believe me, all parties WILL change there story, it always happens. that's why most cases are settled as partial fault.
one thing I hate is two people sitting in the middle of traffic with little more than a fender bender, just because they think the police are going to render a decision on fault

Yea that's one thing I'm gonna make sure of...the HFP kit I have on there is screwed up now on the left side, along with the front and rear pieces. I think they might have to be replaced too.

We got one anyway. The officer took down statements from both drivers and the passenger in the other car for what that's worth. The cop was telling me that he couldn't issue any tickets since she has to cross into my lane to make that turn but it will reflect in the report that she is at fault.

Yes, but if I had called the police on the spot I don't think they would have changed their story. I'm pretty certain they decided after they got home (or talked to someone in the know) they could get away with it.
rockstar143 05-20-2009, 11:50 AM Thanks man...trust me, I thought so too! I had put the HFP kit on 2 weeks before totalling it. I got a killer deal on it and was able to sell back most of the parts on it and make some money overall. That went toward the suspension for the RSX.
Point I was driving home was as long as you make it out of the accident ok, everything is fixable and sometimes even improveable. :banana:

wait until the adjuster comes and writes up the estimate for you to bring to a shop.. they will low ball it.. they will say it will cost 3500 to fix and the shop will have to take it..
its like health ins.. you go to emergency room and it will cost you 2 grand for the visit if you are paying out of pocket.. but the ins company would only pay $350.00 because thats what they are contracted to pay.. hospitals have to accept the ins companies money.. thats the beauty of having ins..
same with with auto.. a shop will rape you if your paying out of pocket.. have her ins companies adjuster come and look over the car to assess the damage... the adjuster will give you an estimate right there.. you just tell them where you are bringing the car.. they give you the invoice for what needs to be repaired and what they, "the ins company" pays for each part, paint, labor.. etc..
in most cases the body shop will call the ins company while the car is apart and say oh when we took the fender off there was damage here and damage there that the adjuster missed.. so the ins company will just cut an extra check for the extra damage they find.. its a grey area... if you get a good guy at a shop, he can hustle the ins company and get a few extra bucks to get you a mod, say a spoiler or grille, maybe a front lip... im just saying examples..
but like i said.. you got an estimate for 4700.00.. the adjuster will probably write an estimate for 3500.00 and you can bring that to the shop that gave you the original estimate and they will accept, you'll see..
body shops make their money on the self pays not the insured..

OK, let me go ahead and clear the air for you here. Yes, they do know what a clay bar is for and yes they are joking. It's the same thing as when I had my car rear ended over a year ago. Someone mentioned that I could just "Buff that right out". It's a joke that has been done on here for quite some time. Might be judged as bad humor to some, but for others it gives them a laugh in spite of their unfortunate mishap. I know I got a chuckle when it was mentioned to me on my situation. I think the point that most people are trying to make is that the situation is not that bad and could of been worse. All parties involved are OK and the car can be repaired or replaced.

Exactly, always get a police report, often the threshold for police to come out to the scene is based on the estimated amount of cost for repair.
As a minimum, if the other driver is at fault, then get their insurance info without giving yours to them, then get info of any witnesses around the scene, then go to the police to make the report if the police decides not to come out.
Have a police report is often invaluable, especially when the other party has had time to think about ways of evading responsibility.
rsnow24 05-25-2009, 04:29 PM The adjuster for my insurance company used the same estimate as the shop, even though the other insurance company's came in with a lower one. I am going with my company, so I had the shop hold off on ordering the 2 wheels in hopes of getting a set of aftermarket ones for the car.
By the way, the rental company thought that this was the most comparable car that they had...so this will be my ride for the next week or two.

Just moved to Hanover less then a year ago for grad school. Such a beautiful area, definitely made the right choice coming here.
