Honda Warranty 2008 Accord

This is my story. Was driving home from my folks home on Sunday June 12 2011 (about 30km drive) in my 2008 Honda Accord 4cyl EX. When i got home went it was about 4:00pm. At about 6:00pm went back to the car started it up again, and a bunch of white smoke came out of my rear muffler. Immediately i shut her down. Suspected a blown head gasket. In the morning I had it towed to the local dealer for warranty. On Tuesday the dealership called me to ask for receipts of work that was done to the car in a prior accident. I obliged and had it faxed to them on Thursday afternoon around 3:00. They called me today Monday June 20th and said the cars engine wasnt covered under warranty. When I asked the service attendant why, she had no answer as she directed me to Honda Canada. She gave me the phone number and it was the wrong one, the person on the line told me to call the service manager as he would know the answer. So i called the manager and asked why wasnt the car under warranty he directed me back to Honda Canada with the right phone number. Nobody could give me a straight answere. So i called and spoke to a gentleman there and he told me after putting me on hold for a minute or so that the service manager should have told me. So after holding some more he told me the engine was no longer under warranty because it was rebuilt after an accident. I told him all the work was done at a Honda dealership with all genuine Honda parts. He said only the original parts of the new car are covered under warranty and to read the warranty. He also advised me the cause of the problem was that I got into an accident 2 years ago 60,000km ago in March 2009 and that any repairs because of an accident are not covered under new car warranty. The car had 20,000km original kms on it at the time of the accident. The work done was a complete engine rebuild and new radiator totaling $15000 charged to my insurance company.
This is what i got from reading the warranty.
9.Your genuine Honda replacement parts warrantyOne year or 20,000km which ever comes first.............................
...
...
...
Parts or components replaced during the original vehicle warranties receive the balance of the original applicable warranty.

No Warranty shall cover:1......
2. Any repairs required as a result of a collision, accident, neglect, racing or misuse.

So my gripe is that it does not say anything about rebuilt motors and that the damages were not caused by an accident. I just started up the car and it went up in smoke.
Estimated cost of repairs $5850 for new used engine and new radiator.
I would really appreciate it if someone could give me some feedback, comments or advice. Thank you in advance.

You best bet is to take it to the dealer that did the repair work and try to work something out with them. Item 9 you highlighted is talking about parts replaced under warranty, example if your radiator just randomly failed at 10k miles the new one would be covered until the end of the new car warranty. It does not mean that parts replaced because of an accident are covered until the end of the new car warranty, which is what item 2 is telling you.

You need to talk to the original dealer that did the repair work and see what their labor warranty is, although you are probably past it. You are past the parts warranty as seen in item 9. The dealer may be willing to do the repair for free or at a reduced cost, but no guarantees.

Wouldnt number 9 implie if a part was purchased after warranty, ie:timing belt, a genuine replacement part, it would be protected by the genuine Honda parts warranty for two years 20,000km and that parts replaced during the warranty period(ie: i chose to do an optional maintenence service such as a timing belt change at 80,000km done by a Honda dealership) are subject to the balance of the original warranty?
Also in the warranty it states "No warranty shall cover: any repairs required as a result of a collision, accident....
It does not say direct result or indirect result.
Also they have not provided me with any documentation proving without a shadow of a doubt that the workmanship or parts caused the failure.

I had my 2008 K24Z3 motor go out with a loud thunder and clunk
The Honda dealer tried to void warranty for reasons of doing all oil and filter changes myself. To my luck, I had saved all the receipts and kept a detailed log book. On top of that, I showed them the paper work that the engine was making rattling noise at 5500RPMs and they just ignored it totally.

I ended up with 2011 spec Brand NEW engine (not a remanufactured).
