So a drunk driver rear ended me at a stop light....





I think my frame is bent....I tried opening the passenger rear door and something is definitely rubbing...

Yup...drunk driver wasnt even wearing a seatbelt...police arrested him on the spot for DWI...I was going to go through his insurance but my claims lady said if I go through his insurance, it might take a while since his insurance needs to talk to him first before they process any claims. Seeing as how he's being arrested, not sure how long that would take so I went through my insurance policy instead. So hopefully my insurance will get my deposit back in the future.
 
That stinks bro. I hate drunk drivers-fools.

When all the dust settles, you'll likely find that this is not his first offense. I won't get started on our so called "justice" system, I might not be able to stop.

Well the police officer said he has insurance...so I dont know. Right now im just more worried about my car. It's never gonna drive the same again.

I wonder what the collision shop will say about all those V3s I installed. The driver turn signal went out... :/

Well i bruised my right knee but nothing major i dont think.....sorry...im still in shock
 
Go through his insurance, he's at fault. You shouldn't have to pay a cent, especially if this is a DWI situation.

Added: get yourself checked out tomorrow, any injuries you've sustained you can file against him because of his irresponsibility getting behind the wheel drunk.

I wouldn't be too worried about the LED turn signals.
I used to have a honda civic that was also full LED from front to back as well as retrofitted headlights. After a collision, the shop even helped remount an LED strip I had under the headlight (Similar to the LED DRL).

If you're going to a Honda collision shop, they really won't care what kind of lights are installed. They'll likely just replace it with a regular bulb if it isn't working.
My shop even offered to help source out a repair shop for my retrofit lol

Well I talked to my insurance and they said that I can definitely go through his insurance, but the problem is that they're not gonna do anything until his insurance talks to him. Since he's arrested for DWI, it might take a while for his insurance to talk to him. I have work at my internship and the last part of my CPA exam is in a couple weeks so I dont have the luxury of time.

My best friend that works at the insurance that I have said it is generally better to go through ur own insurance and they will get the money back from the guy.

ooh that's good to hear. Well one of my rear V3 LED turn signal is out, but I was just afraid they might remove it and dispose of it. The best friend (mentioned above) said to call them early Monday morning to let them know that I want them saved.

Sigh...Thanks for listening DA...I cant believe this is my second rear end collision in less than a year. :thumbsdow

Ask your friend about the statute of limitations regarding how long after the incident you can still make a claim for injuries. Was tboned once and since I went to hospital to be checked out the clock was set and I could still claim unforeseen injuries even after 2 years? Don't remember exactly. I was told by state farm agent if I refused medical I had no future recourse for injury. I didn't have any but nice to have in pocket for latent unknown injuries.
At least that was the case 25+ years ago. Ask your friend in the industry.
If you can afford it get car fixed and get rid of it. IMO they never drive the same EVER.

Sorry you had this happen to you. On a car forum, this is our worst nightmare. Fortunately, it doesn't sound like you were injured too severely and that's the most important thing. Remember, it's just a car.
 
I am not one for suing if it was a simple accident, but this fool was drinking. I would sue his ass and get money from his insurance company.

I agree with this to a point. are you hurt or just still in shock? my wife made a mistake and pulled out in front of another car years ago because she didnt see them very well due to the a pillar on the pass side. she was completely at fault and admitted that. the couple went to the hospital and nothing was ever heard of after. well wouldnt you know it, the day before the 2 year statute of limitations was up, they filed a lawsuit for 500k. the guy claimed he was no longer able to "satisfy" his wife due to the accident along with other problems they say occurred from it.

im not defending drunk driving because thats something that should never happen, but imo if you arent hurt then leave a civil lawsuit alone. its nothing but stress for both parties. the other guy will do his time and pay his fines for being drunk. now if you are hurt, definitely get looked at. other than that, you have more important things to worry about it seems. good luck tho, accidents ****. hope you dont have to go thru any hassles.
 
You are doing right going through your insurance, let them battle it out with the other insurance.
Please go get checked out, even if it's just one of those corner street clinics just so something is documented.
You car can be fixed or it can't. If it can't, since it's a new car insurance will take care of it and make it right.

I agree with this...drinking is voluntary and against the law..he deserves to be sued...
Completely disagree. If you are seriously injured or disfigured, go after the bastard. If you walked away unharmed thank God and count your blessings and walk away.

If you want to get revenge, actively follow the case, write the DA, attend the hearings and address the court for a stiffer punishment. That is making him pay. The only people that "pay" when you go after his insurance company are those of us who have never had an accident or claim with higher premiums.

Now, that being said. If they do not total your car and fix it, I would go after his insurance company for "diminished value" of your car. Once it hits the carfax that your car had an accident, the value drops and you are owed that. I have seen people successfully get compensated for diminished value of their car.

Good luck! I'm very glad that you made it out relatively unharmed.
